Our service is offered on a no win, no fee basis. If your claim is successful, a success fee may apply of up to 30% plus VAT if your case settles before any court action starts or 40% plus VAT if it settles after court proceedings have started, calculated on the amount we recover for you. This only becomes payable once the 14-day cooling-off period has passed. You may cancel at any time during the cooling-off period at no cost. After this period, we may charge for reasonable costs incurred. Those reasonable fees will be based upon a proportion of the work carried out when compared to the full service we have agreed to supply to you.
If your case proceeds to litigation, our fees may be charged differently (for example, a combination of hourly rates and a success fee). In successful court proceedings, some fees may be recoverable from the defendant. If your claim is unsuccessful at litigation, we are not entitled to payment of our fees; however, you may be liable for adverse costs, which can include the defendant's legal costs and disbursements.
To protect you from this risk, we would usually recommend taking out After the Event (ATE) insurance, which (subject to policy terms) can cover adverse costs. We can arrange this for you if your claim progresses to litigation. We would only ever recommend litigation where we believe it offers a better potential outcome for you—such as a higher settlement— than the FCA's proposed Consumer Redress Scheme.
